Burlington Chiropractor Accused of Inappropriately Touching Female Patients

Burlington, WA – A Burlington Chiropractor has been accused of  inappropriately touching two women patients during office visits.

According to probable cause affidavits of arrest obtained by SkagitBreaking.com through a public disclosure request, Burlington Police were dispatched to reports of a possible sex offense in November of 2017 that had occurred  at Skagit River Chiropractic located in the 800 block of East Fairhaven Avenue in Burlington.

The reporting party told Officers that she was touched inappropriately in her crotch area during her adjustment appointment  by her Chiropractic Doctor, identified in court documents as 32-year old Benjamin Joshua Bergevin. 

According to the reporting party, she had been going to the Chiropractic Doctor regularly until this last time when the Doctor had allegedly inappropriately touched her.  Court Documents show that the Doctor had asked the woman  on several occasions during her last appointment if she was “good or okay” while he was inappropriately touching her.  The woman told the Doctor she wasn’t okay and that wasn’t the area he was supposed to be adjusting.  The woman said the Doctor continued to touch her and she again told him “No.”  The woman left the Office and contacted the Police Department to file a report.

On December 13th, 2017, Burlington Police were again dispatched to a Sex Offense report that had allegedly occurred at Skagit River Chiropractic. A woman was reporting to the Officers that she had been inappropriately touched at her chiropractor appointment earlier in the day.  This woman reported being inappropriately touching by Doctor Benjamin  Bergevin during her appointment. The Doctor also allegedly asked her if she was “okay or uncomfortable” as he touched her. The woman said she left and reported the incident to police.

Burlington Officers Interviewed Doctor Benjamin Bergevin, and he denied any allegations of inappropriate touching.

Burlington Police referred Charges on Doctor Benjamin Bergevin on August 6th, 2019  for two counts of indecent liberties (RCW 9A:44.100.1.D).  Indecent Liberties is defined as “Knowingly causes another person to have sexual contact with him or her when the perpetrator is a health care provider, the victim is a client or patient and the Sexual Contact Occurs during a treatment settlement.”

Bergevin was arrested on August 15th, 2019 and booked into the Skagit County Community Justice Center. He was later released on $15,000 bail and has pleaded not guilty to both charges.

As a condition on his release, Bergevin is not allowed to treat or be alone with any female patient without a third party present.

According to the Washington State Department of Health, Chiropractor Benjamin Joshua Bergevin holds an Active Chiropractor License that was initially issued on April 27th, 2012. The License was last issued on April 9th, 2019 and is not set to expire until April 19th, 2020. No enforcement action has been taken by the Department of Health.
