Burlington Father/Son Arrested for Sex Crime Against Whatcom Teen

Whatcom County: In April of 2014, The Whatcom County Sheriff’s Office received information that a 14 year old female was in a sexual relationship with two Skagit County men, a father and son, who were over the age of 18.

The relationship was discovered by an adult female who was dating the girls father.  The girl had logged into her Facebook social media account on the woman’s cell phone, and it was later seen by the woman who notified Law Enforcement.  The girl had met the two men through an app called Whisper, which is an anonymous social media network that let’s people share confessions, express themselves and meet new people online.

According to the probable cause affidavit for arrest, when questioned, the 14 year old girl disclosed to the woman that she had sex with 21 year old Adam Kirkby of Burlington either on or around April 8th, 2014. She also had inappropriate sexual communications and relations with 52-year old Mark Kirkby of Burlington, the Father of Adam Kirkby.

The girl told investigators that Mark Kirkby picked her up at the mall and drove her to meet Adam Kirkby so the two could have sexual intercourse.

Detectives from Whatcom County  were provided the Facebook login information for the girl and reviewed messages between the three involved parties.  The messages between Adam Kirby and the girl  started in December of 2013 and ended in April of 2014. The message were mostly sexual in nature.   The 14 year old girl sent multiple pictures of herself in various states of undress to the two men.

The messages between Mark Kirkby and the girl started in January of 2014 and went until April 2014.   Some of the messages stated the men knew the age of the girl, as well as requests for additional nude photos. The messages were graphic in nature and we have chose not to share details of the message. 

In March of 2014, a relative of the 14 year old girl contacted the two men and the men chatted online with the relative about the age of the victim.  In one message the men stated they knew her age and “it was their secret” and in another message Adam states,  “Ok, If you get pregnant before you’re 18, you can’t  keep it otherwise I’d go to jail.”

The investigation revealed that Mark Kirby had electronic communications with the 14 year old girl on 5 separate dates between March 6, 2014 and April 8th, 2014 where the discussions were sexual in nature.  Adam Kirkby had electronic communications with the girl on 9 separate occasions between January 8th, 2014 and April 9th, 2014 where the discussions were sexual in nature. In a conversation on March 21st, 2014, Adam asks the victim about a previous time they had sexual intercourse.

A search warrant was issued for the Burlington apartment where the men involved lived  and as a result, 4 laptop computers, 3 cellular phones, various sex toys (which were referenced in some of the online communications) and various portable data storage devices were seized.

The two men were arrested. Adam Kirby was charged with 4 counts of Communication with a Minor for immoral purposes and 4 counts of Rape of a Child in the Third Degree.  Mark Kirby was charged with 5 counts of Communication with a Minor for Immoral Purposes.

Mark Kirby has plead guilty and has been sentenced to  serve about 5 and 1/2 years in prison for his role in the incident followed by 3 years of probation. He will also be required to  be registered as a sex offender when released.

The case against Adam Kirby is still pending.
